A variation notice tells the builder, in writing, that you consider particular work a change to your contracted scope — before or as the work is done, not after the argument starts. It is commercial correspondence, not a legal document. It records the instruction received, the changed scope, the price basis and the time impact.

What the notice must capture

A variation argument is usually lost on missing detail, not on the principle. The template includes the fields that matter:

  • Project and contract reference
  • Date of the notice
  • Instruction received — who gave it, when, and whether it was verbal or written
  • Description of the varied work and why it is outside the contracted scope
  • Price basis — quotation, dayworks, or schedule of rates
  • Estimated cost
  • Time impact
  • Attachments — photos, day labour docket references, marked-up drawings
  • Approval signature block

Notify before the work, not after the argument

The value of a variation notice is its timing. Issued before or during the work, it puts the builder on notice while the decision to proceed is still theirs, and it records the instruction while everyone remembers giving it. Issued after the account is queried, it reads as an afterthought — and by then the site personnel who gave the instruction may be gone.

No written instruction? Docket the work the day it happens. A day labour docket signed by the builder's representative on the day is the contemporaneous record that supports the notice.
